1. acceptance

By creating an account or using the Whimsy platform, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. your account

You are responsible for maintaining the security of your account credentials. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for all activity under your account.

3. your store

You retain ownership of all content you upload to your store. By using Whimsy, you grant us a license to display, distribute, and promote your content as necessary to operate the platform. You are responsible for ensuring your products comply with local laws.

4. prohibited content

You may not sell illegal goods, counterfeit products, weapons, drugs, or any content that infringes on intellectual property rights. We reserve the right to remove content or suspend accounts that violate these terms.

5. payments

Whimsy processes payments through third-party providers. We do not charge transaction fees on our platform, but standard M-Pesa and card processing fees apply. Subscription fees are billed monthly or annually depending on your plan.

6. limitation of liability

Whimsy provides the platform "as is." We are not liable for lost sales, data loss, or any indirect damages arising from your use of the platform. Our total liability is limited to the fees you've paid in the preceding 12 months.

7. termination

You can close your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, you can export your data within 30 days.

8. changes

We may update these terms from time to time. We'll notify you of significant changes via email. Continued use of the platform after changes constitutes acceptance.

9. governing law

These terms are governed by the laws of New York, USA. Any disputes will be resolved in the courts of New York, USA.
